1. Agreement

These Terms of Service ("Terms") govern your access to and use of xapply's website, waitlist, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy policy. If you do not agree, do not use the Service.

2. What the service does

xapply provides tools and technology intended to help job seekers prepare and manage applications, including AI-assisted features. Specific functionality may change as we develop the product. Features described on the website are illustrative and may not be available in all regions or at all times.

3. Eligibility

You must be at least the age of majority in your jurisdiction (and at least 16) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

4. Waitlist and accounts

Joining the waitlist or creating an account may require accurate contact information. You are responsible for activity under your credentials. We may send transactional and product-related emails consistent with our Privacy policy. You can opt out of non-essential marketing where applicable.

5. Acceptable use

You agree not to:

  • Violate applicable law or third-party rights.
  • Upload malware, probe or attack our systems, or attempt unauthorized access.
  • Scrape, overload, or automate access to the Service in a way that harms availability.
  • Misrepresent your identity, credentials, or employment history.
  • Use the Service to spam employers or circumvent platform rules.
  • Reverse engineer or attempt to extract our models or source code except where permitted by law.

6. No guarantee of employment

xapply does not guarantee interviews, offers, or employment. Outcomes depend on many factors outside our control. AI-generated suggestions may be inaccurate or incomplete; you are responsible for reviewing and submitting accurate information to employers.

7. Intellectual property

The Service, branding, and content we provide are owned by xapply or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the Service. You retain rights in content you submit; you grant us a licence to use that content to operate and improve the Service as described in the Privacy policy.

8. Third-party services

The Service may link to or integrate with third-party sites and job platforms. Their terms and privacy policies apply to your use of those services. We are not responsible for third-party content or practices.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XAPPLY AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) INR 5,000, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

11. Subscriptions and fees

Paid plans, if offered, will be described at checkout. Fees are non-refundable except as required by law or as stated in a specific offer. We may change pricing with reasonable notice where required.

12. Suspension and termination

We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or if we discontinue the Service. You may stop using the Service at any time. Provisions that by their nature should survive will survive termination.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to mandatory consumer protections in your jurisdiction, courts in India shall have exclusive jurisdiction over disputes, unless we agree otherwise in writing.

We may modify these Terms by posting an updated version on this page. Continued use after the effective date constitutes acceptance of the revised Terms where permitted by law.
